fa طراحی الگوی قراردادهای هوشمند قابل‌اجرا در بستر بلاک‌چین برای ایمن‌سازی معاملات نفت وگاز Designing a Model of Smart Contracts That Can Be Implemented on The Blockchain Platform to Secure Oil And Gas Transactions قراردادهاي نفتي-حقوقي Contracts رساله(پايان نامه) دكتري Thesis(PhD.) صنعت نفت‌وگاز به‌عنوان یکی از حیاتی‌ترین بخش‌های اقتصادی، به دلیل پیچیدگی‌های حقوقی، فنی و مالی، در اجرای قراردادهای بین‌المللی با چالش‌هایی همچون عدم شفافیت، ضعف زیرساخت‌های اندازه‌گیری، تأخیر در تسویه‌حساب‌ها، تحریم‌های بانکی، ریسک‌های امنیت سایبری و افزایش اختلاف میان طرفین قرارداد مواجه است. این چالش‌ها ضرورت بهره‌گیری از فناوری‌های نوینی مانند بلاک⁠چین و قراردادهای هوشمند را برجسته می‌کند. مسئله اصلی پژوهش حاضر، فقدان الگویی جامع و قابل‌اجرا برای بهره‌برداری از قراردادهای هوشمند در ایمن‌سازی و بهینه‌سازی معاملات گازی است. هدف پژوهش، طراحی الگوی قراردادهای هوشمند قابل‌اجرا در بستر بلاک⁠چین به‌منظور افزایش امنیت، شفافیت و کارایی معاملات نفت‌وگاز است. این مطالعه با رویکرد تفسیری و روش کیفی، از طریق مصاحبه نیمه‌ساختاریافته با ۱۳ نفر از خبرگان حوزه انرژی، حقوق و فناوری بلاک⁠چین انجام شد و داده‌ها با رویکرد شبکه مضامین آتراید- استرلینگ تحلیل گردید. یافته‌ها نشان می‌دهد که قراردادهای گازی در وضعیت موجود با چالش‌های چندبعدی فنی، حقوقی، اقتصادی و مدیریتی مواجه هستند. تحلیل داده‌ها به استخراج ۳۳ مضمون پایه، ۶ مضمون سازمان‌دهنده و یک مضمون فراگیر منجر گردید که ابعاد الگوی پیشنهادی را شکل می‌دهد. الگوی نهایی شامل الزامات فنی (بلاک⁠چین مجوزدار، اوراکل‌های چندمنبعی، هویت دیجیتال)، الزامات حقوقی (تدوین قوانین جدید، الحاقیه قراردادها)، الزامات مالی (تسویه با توکن پایدار) و الزامات مدیریتی (آموزش، پایلوت، کمیته مشترک) است. نتایج نشان می‌دهد که بهره‌گیری از قراردادهای هوشمند می‌تواند اختلافات قراردادی، تأخیرها و هزینه‌های اداری را به‌طور معناداری کاهش داده و شفافیت، امنیت و اعتماد میان طرفین را در معاملات گازی افزایش دهد. طبقه بندی JEL: J22, R5, Q41, M12. کلیدواژه‌ها: قرارداد هوشمند، بلاک⁠چین، معاملات نفت‌وگاز، ایمن‌سازی معاملات، شبکه مضامین.   The oil and gas industry, as one of the most vital sectors of the economy, faces numerous challenges in implementing international contracts due to legal, technical, and financial complexities. These challenges include lack of transparency, weak measurement infrastructures, delays in settlements, banking sanctions, cybersecurity risks, and increasing disputes between contracting parties. Such issues highlight the necessity of adopting emerging technologies such as blockchain and smart contracts. The main problem addressed in this study is the absence of a comprehensive and applicable model for utilizing smart contracts to secure and optimize gas transactions. The purpose of this research is to design an executable smart contract model based on blockchain in order to enhance the security, transparency, and efficiency of oil and gas transactions. Employing an interpretive paradigm and a qualitative methodology, the study collected data through semi-structured interviews with 13 experts in the fields of energy, law, and blockchain technology, and analyzed the data using the Attride-Stirling thematic network method. The findings indicate that gas contracts in their current state face multi-dimensional technical, legal, economic, and managerial challenges. Data analysis resulted in identifying 33 basic themes, six organizing themes, and one global theme that together form the dimensions of the proposed model. The final model encompasses technical requirements (permissioned blockchain, multi-source oracles, digital identity), legal requirements (new regulatory frameworks and contractual addenda), financial requirements (stable-token settlement), and managerial requirements (training, pilot implementation, joint committees). The results demonstrate that deploying smart contracts can significantly reduce contractual disputes, delays, and administrative costs while improving transparency, security, and trust between parties in gas transactions.
