fa ارزیابی نظام مالی قراردادهای نفتی بیع متقابل و قرارداد جدید نفتی ایران با ‌استفاده از تکنیک ‌TOPSIS‌ قراردادهاي نفتي-حقوقي Contracts پژوهشي Research <p dir="RTL">یکی از مهم‌ترین بخش‌های قراردادهای نفتی، رژیم مالی است. شروط مربوط به رژیم مالی، اختصاصی بوده و بر اساس مذاکرات طرفین تنظیم می‌شود و نقش بسزایی در موفقیت قراردادها و رضایت طرفین از آن دارد. در مقاله حاضر ماهیت و ساختار نظام مالی در قراردادهای بیع متقابل و قرارداد جدید نفتی ایران معرفی گردیده سپس با مرور متون مربوط به نظام مالی و مصاحبه با خبرگان نسبت به انتخاب معیارهای ارزیابی تأمین مالی اقدام شده است. به منظور مقایسه معیارهای ارزیابی جهت اولویت‌بندی و همچنین انتخاب بهترین روش تأمین مالی در قرارداد بیع متقابل و قرارداد جدید نفتی ایران از نظر خبرگان و به‌کارگیری روش تصمیم‌گیری <span dir="LTR">TOPSIS</span> بهره برده شد. با توجه به نتایج حاصل از روش تصمیم‌گیری <span dir="LTR">TOPSIS</span>، معیارهای تأمین و جذب سرمایه‌گذاری خارجی، برداشت صیانتی از مخزن و انعطاف‌پذیری&rlm; منطقی در شرح کار و هزینه‌های تکلیفی پیمانکار &rlm; از اولویت بالاتری در نظام مالی دو قرارداد برخوردار بوده و بر اساس معیارهای معرفی شده، قرارداد <span dir="LTR">IPC</span> به عنوان قرارداد مناسب برای صنعت نفت ایران شناسایی گردید.</p> <p><strong>Abstract. </strong>One of the most important parts of oil contracts is the financial regime. The terms of financial regime are proprietary and governed based on negotiation between parties, and they play a significant role in the success of the contracts and the parties&rsquo; consent. In this article, the nature and structure of the financial system are presented in the buyback contract and the new oil contract of Iran. Then, by reviewing the literature &lrm; related to the financial system and interviewing the experts, it has been decided to choose criteria for assessment of financing. In order to compare the evaluation criteria for prioritization, as well as to choose the best financing method in the buyback contract&lrm; and the new oil contract of Iran, the experts&rsquo; opinions and TOPSIS decision-making method were used.
